About Media Consultants, Inc.

MEDIA CONSULTANTS, INC. began operation as an audiovisual and motion picture production company in Durham, North Carolina in the spring of 1972 and was incorporated on July 8 of that year. It is owned and managed by Carl Gilfillan, a native of Cary, North Carolina.

Media Consultants, Inc. has been a well-known audiovisual service facility since 1973, and was long associated with the North Carolina Public Schools as an educational sales and service organization.

An important milestone occurred in 1975 when the company moved to Cary. The year 1979 saw a major shift for the company from film as a production medium to the rapidly developing video format.

The company moved in 1990 from its longtime home in downtown Cary to facilities in the Tanager Center on Highway 54. In June of 2000, the company moved its production facilities to concentrate on production, internet e-commerce, and a new packaging and printing operation.

Overtime

Overtime is billed after a normal 8 hour day, on weekends, and on holidays. The overtime charge is 1 and 1/2 TIMES the Normal Charge shown on this rate card. On production of programs, overtime at 1 and 1/2 Times the Normal Rate may also be charged for production crew and talent.

Rush Charges

RUSH CHARGES apply to the timely delivery of any production, duplication, or service which can not normally be accomplished within our normal work load. The customer will be notified in advance if rush charges apply. RUSH CHARGES = $25.00 + 2(X) NORMAL CHARGE.

Copyright

By contracting with MEDIA CONSULTANTS, INC. to provide various audiovisual services, the customer agrees to hold MEDIA CONSULTANTS, INC., its employees, suppliers, and contracted persons, harmless and without risk or liability in any suits, claims, damages, liabilities, losses, or expenses regarding violation of copyright laws or any infringement of copyrights or performance rights. All productions, services and duplications are undertaken by MEDIA CONSULTANTS, INC. with the express understanding that the customer has legal right, either by ownership or legal permission of the copyright holder, to use the master materials. In certain instances of using clearly marked copyrighted materials, MEDIA CONSULTANTS, INC. may require the customer to sign a written statement certifying permission to use such materials.

Terms

NET 30 DAYS. A 1 1/2% monthly (18% APR) late fee will be added to the total balance for those accounts more than 30 days past due. Accounts more than 60 days past due must be placed on a C.O.D. basis until the account is cleared.

Credit

Payment for services is due in full at the time of completion of each day, booking, or session, unless credit has been previously arranged with our credit manager. We do not charge to individuals. Companies, foundations, agencies and corporations should obtain a copy of our CREDIT APPLICATION to establish a new account. Please remember that it normally takes 2-4 weeks to approve a new account. Credit Limits (usually $300) are set for new accounts until we are able to establish a credit history based on a billing cycle (usually 30-60 days). Our accounting personnel will discuss this with you before any production services are begun. Purchase orders or work authorization numbers are usually required by most companies before work begins. Please remember that we must follow the required procedures as established by your company’s policies for accounts payable.

Company Lien

All master materials are accepted by MEDIA CONSULTANTS, INC. under the express condition that MEDIA CONSULTANTS, INC. holds a lien against those materials for the general balance due the company from the customer. Upon full payment, title to such materials may be released to the customer subject to any conditions as may have been separately agreed upon. The customer may be held liable under applicable law for any broadcasting or other public performance of the materials before full payment has been received.

Damages and Claims

MEDIA CONSULTANTS, INC. shall have no liability for incidental or consequential damages arising from a breach hereof, or from MEDIA CONSULTANTS, INC. failure to provide services or deliver materials. Further, MEDIA CONSULTANTS, INC. makes no warranties, expressed or implied, of the merchantability, fitness, or suitability of any materials or services provided to a customer under these terms. Any claims relating to materials or services must be made in writing within ten days of the receipt of such materials or services. Failure of the client to make such claims within the ten day time period shall constitute acceptance by the customer of the materials and/or services, and by such failure the client shall accept the obligation of timely payment for the materials and/or services.

Limited Liability

MEDIA CONSULTANTS, INC. does not guarantee the safety of any materials in its possession during production or in storage, and shall not be held liable for any loss or damage of such materials regardless of the cause of such loss or damage, and liability is limited to the cost of a blank tape. Further, Media Consultants, Inc. reserves the right to return, at the customer’s expense, any or all materials held in its possession for a period of time exceeding ninety days. All customers are strongly cautioned and advised to supply Media Consultants with a DUB MASTER (Sub-Master) of all programs to be duplicated, since the duplication process can result in a certain amount of degradation and/or damage. MEDIA CONSULTANTS, INC. can not be held liable for aging, deterioration, fading, accidental mechanical damage, fire, floods, theft, vandalism or any natural degradation process which media materials normally undergo.

Warranty

All audiovisual materials produced by MEDIA CONSULTANTS, INC. including tape and cassette duplicates, are warranted against defects in materials and workmanship for a period of 30 days from delivery date. Repair or replacement of such materials will be made at no charge to the customer.

Pickup and Delivery Service

We offer a pickup and delivery service to most areas of Raleigh, Cary, and RTP. The normal charge for pickup or delivery is $20.00, but this charge may be waived for orders totaling more than $100. Please call Bryan for more details.
